“This bill proposes the biggest cuts to Medicaid in the 60 year history of this program,” said Laurel Lucia. “Not only will Medi-Cal enrollees in San Francisco have to worry about their coverage, but hospitals, clinics and other health care providers could see cuts as a result of this bill.”

Labor advocates criticized Proposition 22 as a false promise laid to voters by its proponents. A May study by the University of California, Berkeley Labor Center found out that, despite claims that drivers would earn at least 120 percent of local minimum wages, a majority of drivers earned less than the minimum wage.

A study published yesterday by the UC Berkeley Labor Center delved into what it called a false promise laid out to voters by proponents of Prop. 22 in 2020.

The report investigates how jobs and housing “fit” together. Roughly 50,000 trade and union workers volunteered wage data for the study, which the UC Berkeley Labor Center analyzed and compared to local housing prices.

Ken Jacobs, chair of the University of California at Berkeley Center for Labor Research and Education, said it’s a big win for drivers who challenged the law — but only the first stage, and it could take another year until it’s resolved.

The PRO Act, now in Congress, uses the same test for determining whether a worker is an independent contractor or employee as the test codified in Assembly Bill 5, but this is specifically for the purposes of collective bargaining, said Ken Jacobs, chair of the UC Berkeley Labor Center. Therefore, he said, it would not affect workers’ status for the purpose of other federal laws, such as taxes or minimum wage.
